Subscription and Terms of Use

1. Who provides the service

PirPeek is provided by Furkan Eren, an individual developer. You can reach us at info@pirpeek.com.

PirPeek is an app that lets you keep records of your caged birds, follow the data measured by the PirPeek smart perch and back up your photos.

2. Not veterinary advice

The measurements, charts, alerts, guides and vet report in the app are for information only and do not replace examination, diagnosis or treatment by a veterinarian. Always consult a veterinarian about your bird's health.

3. Your account

You need an account to use the app. You are responsible for keeping it secure and for what is done with it. PirPeek is not intended for users under 13.

4. Plans

The app can be used for free. Paid plans unlock extra features. Today the plans include:

• Free: the last 3 days of sensor history and 10 photo backups in the cloud.
• Bronze: the last 7 days of sensor history, 100 photo backups and the vet report.
• Silver: the last 14 days of sensor history, 500 photo backups and the vet report.
• Gold: the last 28 days of sensor history, 2000 photo backups, the vet report and priority support.

5. Changes to what a plan includes

We may add new features to plans over time. If we change a plan to subscribers' disadvantage, we will announce it in the app before it takes effect, and the change will not apply before the end of your current billing period.

6. Prices and payment

Paid plans can be bought monthly or yearly. Current prices are shown in the app by the store before you buy, including any applicable taxes.

Payment is taken through Google Play on Android and the App Store on iOS, and is subject to the store's terms. Your card or payment details never reach us.

7. Free trial

Users who have never had a subscription in this app can try paid plans free for 7 days where the store offers it. If you cancel before the trial ends, you are not charged. If you do not cancel, the price of the chosen plan is charged when the trial ends and the subscription starts renewing automatically.

8. Automatic renewal

Subscriptions renew automatically for the same period at the end of each period until you cancel, and the price is charged to your payment method in the store at renewal.

9. Changing plans

• Moving to a higher plan takes effect immediately; the store prorates the price difference, taking your remaining time into account.
• Moving to a lower plan takes effect at the end of your current billing period; until then you keep your current plan.
• Switching from monthly to yearly takes effect immediately; switching from yearly to monthly takes effect at the end of the period.

10. Cancellation

You can cancel your subscription at any time. After cancelling, you keep your plan until the end of the paid period; your account then returns to the free plan.

Deleting your account does not cancel your subscription. To avoid being charged again, cancel it in the store.

• Android: in the Google Play Store app, tap your profile icon, then Payments & subscriptions > Subscriptions > PirPeek > Cancel subscription, or open https://play.google.com/store/account/subscriptions
• iOS: go to Settings > your name > Subscriptions > PirPeek.
• In the app: the Manage subscription button on the Settings > Subscription screen takes you straight to the store's subscription page.

11. If a payment fails

If a renewal payment fails, the store may give you extra time to update your payment method, during which your plan may stay active. If the problem is not resolved, paid features are paused and the subscription ends.

When a subscription ends, your data is not deleted; only the free plan's limits apply. For example, a shorter part of your sensor history is shown and, once the quota is full, new photos are not backed up to the cloud; your existing backups are kept and can still be viewed and deleted.

12. Refunds and right of withdrawal

Because purchases are made through the store, refund requests are handled under the store's refund policy. For Google Play purchases, you can request a refund through Google Play; if you run into problems, you can also write to us.

Because the subscription starts being performed electronically and immediately once you confirm the purchase, it may fall outside the right of withdrawal under Article 15 of the Turkish Distance Contracts Regulation. This does not affect your other rights under consumer law. The free trial lets you try the plans before paying.

13. Acceptable use

You agree to use the app lawfully and only for the care of your own birds. You must not:

• upload content that infringes others' rights or is illegal or obscene,
• try to bypass the service's security, access other users' data or disrupt the service by overloading it,
• copy, sell or reverse engineer the app or the perch's software without permission.

14. Suspension

We may suspend or close your account for serious or repeated breaches of these terms. Where possible, we will notify you by email before doing so.

15. Intellectual property

All rights in the app, the perch's software and the content of pirpeek.com are reserved. Your own records and photos belong to you; we only process them to provide the service to you.

16. Limitation of liability

We take care to keep the service running without interruption or errors, but outages may occur due to maintenance, the network or our infrastructure providers. Measurements may vary with how the device is set up and the surrounding conditions. To the extent permitted by law, we are not liable for indirect damages arising from the use of the service; this limitation does not apply in cases of intent or gross negligence, or to rights granted by consumer law.

17. Changes to these terms

We may update these terms. The current version is always on this page, and we announce significant changes in the app before they take effect.

18. Governing law and disputes

These terms are governed by the laws of the Republic of Turkey. Consumers can apply to consumer arbitration committees within the statutory monetary limits, and to consumer courts above them.
